Candidate Privacy Statement
Overview
As part of our candidate application and recruitment process Netcel Limited (“we”, “our”, “us”, “the Company”) collects, processes and stores personal information about you. We process this information for a range of purposes relating to the recruitment process and this may include your application, assessment and offer of employment.
Throughout this Privacy Notice we use the term “processing” to cover all activities involving your personal information, including collecting, handling, storing, sharing, accessing, using, transferring and disposing of the information.
What information do we collect?
The Company collects a range of information about you. This includes:
- your name, address and contact details, including email address and telephone number;
- details of your education, qualifications, skills, experience and employment history;
- information about your current level of remuneration, including benefit entitlements;
- whether or not you have a disability for which the organisation needs to make reasonable adjustments during the recruitment process;
- Special category data to monitor diversity and inclusion;
- information about your entitlement to work in the UK;
- Assessment results e.g. results from technical tests.
The Company may collect this information in a variety of ways. For example, data might be contained in application forms, CVs or resumes, information received from Third Party recruitment agents or covering letter from yourself, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment.
We may also collect personal data about you from third parties, such as references supplied by former employers. We will seek information from third parties only once a job offer has been made to you and we will inform you that we are doing so.
Data will be stored in a range of different places, including on your application record, in HR management systems and on other IT systems (including email).
Why do we collect your personal information?
In order to manage your application, we need to process certain personal information about you. We only process your information as necessary for the purposes of progressing your application or as required by law or regulatory requirements, so not all of the purposes set out below will apply to you all of the time.
The Company has a legitimate interest in processing personal data during the recruitment process and for keeping records of the process. Processing data from job applicants allows us to manage the recruitment process, assess and confirm a candidate's suitability for employment and decide to whom to offer a job. We may also need to process data from job applicants to respond to and defend against legal claims.
The Company may process special categories of data, such as information about ethnic origin, sexual orientation or religion or belief, to monitor recruitment statistics. We may also collect information about whether or not applicants are disabled to make reasonable adjustments for candidates who have a disability. We process such information to carry out its obligations and exercise specific rights in relation to employment.
If your application is unsuccessful, The Company may keep your personal data on file in case there are future employment opportunities for which you may be suited. We will ask for your consent before it keeps your data for this purpose and you are free to withdraw your consent at any time.
Who do we share your personal information with?
The Company will need to share your personal information internally and may require to share it with some external parties or associates of the Company. Some of these third parties and associates will be located outside the European Economic Area (“EEA”). Your information will only be shared if it is necessary or required (for example in order to carry out candidate testing).
The recruitment process will involve:
- Assessing and progressing your application,
- Assessing your suitability (skills, strengths, behaviours for the role)
To enable these processes your personal information may be shared internally, but the information shared is limited to what is required by each individual to perform their role in the recruitment process.
Your personal information may be shared internally with the following people:
- Those employees who would have managerial responsibility for you or are acting on their behalf;
- Employees in the Peope Team who have responsibility for certain People processes (for example recruitment, assessment);
- Audit and Investigations employees in relation to specific audits/investigations; and
- Third-party which provide assessment services.
How do we protect your information?
Our HR and Recruitment systems are protected to ensure that unauthorised or unlawful processing of personal information, accidental loss or destruction of, or damage to, personal information does not occur. This is done in accordance with the Information Security Policy.
Where we share information with other parties located outside EEA, as a minimum, the Company will require that such personal information is protected as required by the laws of the country where you work. The Company also requires its third party suppliers or recipients of personal information to guarantee the same level of protection as provided by the Company. Your personal information will be retained in accordance with the Company’s Employment Records Retention & Erasure Policy (which means that we may hold some information after your application to the Company is complete).
Your Rights
As a data subject, you have a number of rights. You can:
- access and obtain a copy of your data on request;
- require the Company to change incorrect or incomplete data;
- require the Company to delete or stop processing your data, for example where the data is no longer necessary for the purposes of processing;
- object to the processing of your data where the Company is relying on its legitimate interests as the legal ground for processing; and
- ask the Company to stop processing data for a period if data is inaccurate or there is a dispute about whether or not your interests override the Company's legitimate grounds for processing data.

If you believe that the Company has not complied with your data protection rights, you can complain to the Information Commissioner.
It is your responsibility to keep your personal information up to date so that accurate application records can be maintained.
For how long does the company keep your data?
If your application for employment is unsuccessful, the Company will hold your CV and application on file for 1 (one) year after the end of the relevant recruitment process.
We may wish to retain your application on file on the basis that a further opportunity may arise in future that we may want to contact you about. We will write to you separately seeking your explicit consent to retain your personal information for a further 3 years. Unless you accept the request, your data will be automatically deleted or destroyed.
At the end of that period, or once you withdraw your consent, your data is deleted or destroyed.
If your application for employment is successful, personal data gathered during the recruitment process will be transferred to your Employment Hero s file and retained during your employment. Your data will be used to start pre-screening check. Before commencing these checks you will be asked for your consent. The periods for which your data will be held will be provided to you in a new privacy notice.
What if you do not provide personal data?
You are under no statutory or contractual obligation to provide data to the Company during the recruitment process. However, if you do not provide the information, the Company may not be able to process your application properly or at all.
You are under no obligation to provide information for equal opportunities monitoring purposes and there are no consequences for your application if you choose not to provide such information.
Automated decision–making
The company’s recruitment process is not solely based on automated decision-making.
